New Bill Wants to Ban Adult Toys Across Texas Stores
In a bill introduced by newly-elected Republican Rep. Hillary Hickland, the Texas lawmaker proposes to limit the sale of adult toys at major retail stores calling the devices "obscene" and wants a law limiting where they're sold.
This just in: did you know that stores like Walmart and Target even sell adult toys? Well, they're not as explicit as you would expect from an actual adult store, but I have it on good authority that they're still pretty legit; and not to mention they're reasonably priced.
Hickland introduced H.B. 1549 which calls for "restrictions on the sale of obscene devices" in advance of the 2025 legislative session. This would affect the sale of the products at retailers like Walmart, Target, CVS and Walgreens. Hickland is not alone in this, in a post on X, fellow Republican Christin Bentley threw her support on this bill.
The sale of adult toys in Texas has been subject to legal scrutiny and evolving interpretations over the years. Historically, Texas had strict obscenity laws that classified adult toys as prohibited items if they were sold or promoted for sexual gratification. However, these laws have been challenged and changed due to constitutional concerns about freedom of expression and personal rights.
The law would take effect immediately if it is approved by two-thirds of Texas House members. If it's approved by a lesser margin, it would become law on Sept. 1, 2025.
Up until 2008, Texas law prohibited the sale of more than six adult toys or devices if they were marketed primarily for sexual stimulation or gratification. Violators could face criminal charges. The law faced criticism for being overly restrictive and outdated.
