Lots of legislation has been passed in Texas during the 89th Legislature.  Most of it benefits Texans, while others have been extremely controversial.  One of the most controversial pieces of legislation, the THC ban, was vetoed by Governor Abbott, while another controversial piece of legislation was put into law.

What Is Senate Bill 379, and What Does It Ban?

As of September 1, 2025, Senate Bill 379 will be an official law, and those who use SNAP benefits will no longer be able to use those benefits to purchase junk food.

What Foods Are No Longer Allowed With SNAP?

By junk food, we mean sweetened drinks like sodas and candy. Drinks containing 5 or more grams of sugar will no longer be allowed on SNAP, nor will packaged candy intended for immediate consumption be allowed.

Can Texas SNAP Users Buy the Ingredients to Make Candy and Sugary Drinks?

SNAP users may buy the separate ingredients and make candy or sugary drinks using ingredients purchased with benefits.

Texans knew that this bill would land on Governor Abbott's desk and he would sign off on it because on May 14, 2025, Abbott sent a letter to the US Secretary of Agriculture, Brooke Rollins, requesting a waiver to prohibit the purchase of snack foods on SNAP.  Authorization from the federal government is required to make these changes.

Why Did Governor Abbott Support the SNAP Ban?

The legislation to ban junk food on SNAP, SB 379, was officially signed by the Governor on June 20, 2025.  If you are on SNAP Benefits, you are allowed to purchase these items until August 31, 2025; after that, you’ll have to use your own money.
